Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website, client area, and services provided by hTech Dev ("hTech", "we", "us", "our"). By ordering, accessing, or using our services, you agree to these Terms.
This document includes service-specific sections for Dev Ops, Web Hosting, and our Acceptable Use Policy (AUP).
1) Accounts, Access & Billing
- You must provide accurate account and billing information and keep it up to date.
- You are responsible for activity under your account credentials.
- Invoices are due as shown in the Client Area. Non-payment may result in suspension or termination.
2) Service Availability & Support
- We aim to provide reliable services, but uptime is not guaranteed unless a separate SLA is explicitly provided.
- Support is provided through our ticketing system and may vary by plan.
- Maintenance and emergency work may require downtime; we will provide notice when reasonable.
3) Dev Ops Services
Dev Ops services may include automation, deployments, monitoring, CI/CD, infrastructure management, and consulting.
- Scope of work: Deliverables and timelines are defined by the plan, statement of work, or ticket notes.
- Customer responsibilities: Provide timely access, credentials, and requirements. Delays may impact timelines.
- Changes: Significant scope changes may require a revised estimate or additional fees.
- Backups: Unless explicitly included, you remain responsible for validating backups and recovery procedures.
4) Web Hosting Services
- Resource usage: Hosting plans include limits (CPU/RAM/storage/inodes/bandwidth). Excessive usage may be throttled or require upgrade.
- Security: You are responsible for your application security (themes/plugins/code). We may suspend compromised accounts to protect the platform.
- Backups: We may provide backups as a convenience where stated, but you should maintain your own independent backups.
- Email: If email is included, you must not send spam or abusive traffic. We may rate-limit or suspend for reputation protection.
5) Acceptable Use Policy (AUP)
You agree not to use our services to:
- Send spam, phishing, or other unsolicited bulk messages.
- Host, distribute, or facilitate malware, botnets, or unauthorized access attempts.
- Engage in DDoS activity, network scanning that impacts others, or abusive traffic patterns.
- Host illegal content, exploitative content, or content that infringes intellectual property rights.
- Attempt to bypass quotas, security controls, or access data you do not have permission to access.
We may suspend or terminate services immediately for AUP violations or security incidents, with notice when feasible.
6) Content & Intellectual Property
- You retain ownership of your content. You grant us rights necessary to host and process it to provide services.
- We retain ownership of our systems, software, branding, and documentation.
7) Termination
- You may cancel services per your plan terms and billing cycle.
- We may suspend or terminate for non-payment, abuse, or legal compliance needs.
- Upon termination, access may be removed and data may be deleted per retention practices.
8) Disclaimers & Limitation of Liability
Services are provided "as is" and "as available" to the maximum extent permitted by law. To the extent permitted, hTech will not be liable for indirect, incidental, special, consequential, or punitive damages.
9) Changes to Terms
We may update these Terms from time to time. Continued use of services after updates constitutes acceptance of the updated Terms.
